Stazo Omungala: Expelling Hon Malala is not only misinformed but also grossly goes against the unity agenda.

We view the recent communication of ANC on the expulsion of one Senator Cleophas Malala as constituting a coefficient of imbalance with unfavourable content to him.

However favourable to the party in the effect of discipline, the errors of procedure in the execution of the discipline disqualifies the act from being just. It wasn’t just unprocedural but too emotional without rational content.

For what is Senator Malala expurged from party register?

Which gross misconduct is levelled against him?

What procedural disciplinary mechanisms have been exploited to warrant such drastic measures?

While appreciating similar actions by other parties with a view of reinforcing internal party discipline, such actions have been taken within the context of political parties act and against blatant violations of the same – and for undeniable gross misconduct and misdemeanor.

Jubilee Party reigned in on their members whose positions were in conflict with the party’s position and grossly violated party rules. ODM acted against their members who seemed to go against political parties act by openly associating with and propagating ideals of another party.

Senator Malala has on the other hand remained steadfast in his defense of the his party ANC. His operations have been within the provisions of both the NASA Coalition and his sponsoring party. He has on no occasion been deviant of provisional regulations and the political parties act.

Disciplinary actions against him are therefore not only misinformed but also grossly violates his rights as a senior party official.

Officially or unofficially, Hon. Malulu Injendi, Hon. Tindi Mwale and Hon. Murunga openly associates with and propagates the ideals of Jubilee Asili. These legislators are close associates of the Deputy President who officially doubles as Deputy Party leader of Jubilee and the leader of errant unofficial Jubilee Asili. No action has been taken against them for such associations.

The party in its defence appears to perpetuate freedoms and rights of association on one hand while on the other muzzles a senior officer whose offences are unclear and unstated.

Could Malala’s offence be in his association with his governor who happens to be the Deputy party leader of ODM? How is he expected to execute his assignment while hostile to his own governor?

Is it his close association with the NASA leader? Should this be the case then ANC is in violation of the pre coalition agreement with ODM

ANC supporting and failing to discipline Hon. Mwale, Injendi and Murunga whose support of Jubilee party is in public knowledge proves their hostility to NASA and unofficial exit from the coalition. It validates their support of Jubilee Asili in contravention of the political parties act. It is therefore necessary that they so declare and act.

Malala has been vocal in his support of Luhya Unity. His involvement in the crafting of mechanisms to realise a unified Western Kenya front cannot be misconstrued to mean disobedience to ANC party as he has on no occassion gotten involved either clandestine or openly with another party without NASA coalition

Finally,
The powers to discipline vested in party organis should not be used to criminalise and victimise seeming vibrancy in the party. There party must allow room for growth without feeling threatened and intimidated by the growth and widespread popularity of their members.

ANC must through its organs join in the quest for ONE LUHYA vote through a United Luhya front or desist from manipulating their members who desire and propagate such ideal. The Luhya nation is not on auction and attempts to so use the community for selfish and egocentric political gains shall be forcefully resisted.
