Aladwa,Imwatok and Ogeto seek anticipatory bail to avoid arrests.

ODM Party Nairobi chairman George Aladwa, MCAs Peter Imwatok and Moses Ogeto have secured anticipatory bail blocking their arrest and detention.

Following the orders issued by Justice Diana Kavedza, the Inspector General of Police and Directorate of Criminal Investigations or their agents have been restrained from arresting the three pending a ruling on the matter.

The security agencies can however summon them in relation to any criminal conduct.

“…That for the avoidance of doubt, the respondents are at liberty to investigate or charge the applicant for any Criminal Conduct. However, they shall not arrest them (unless the applicants fail to honour their summons) and they shall not detain them until further orders of the court,” reads the court documents seen by www.goodmorningkenya.com.

The application and the court order shall be served upon the respondents within 3 days from the date hereof and the respondents shall upon service file their responses within 10 days.

The matter will be mentioned on 26/9/2023 for directions.

The three had moved to court on suspicion of their impending arrest ahead of opposition-led protests that were to take place on Wednesday this week. The Azimio coalition has since suspended the planned protests
