Nairobi court on Wednesday barred the office of the Director of Public Prosecutions (DPP), Directorate of Criminal Investigations (DCI) and the media from commenting on the merits of the Babu Owino and DJ Evolve case.
The court also directed that the matter be mentioned on August 11, 2020 to confirm whether the victim – Felix Orinda, alias DJ Evolve – has recorded a statement.
Babu Owino, through lawyer Cliff Ombeta, raised an objection accusing the DPP overstepping his mandate by allegedly inciting Embakasi East constituents to recall him as their MP.
Ombeta made his submissions before Milimani Senior Principal Magistrate Bernard Ochoi arguing that the said actions of the office of the DPP are “affecting the emotions of the accused person” telling the State prosecutor to “stick in his line.”
The controversial legislator recently attracted public anger following an interview with DJ Evolve aired by NTV in which the victim said that since undergoing surgery following the shooting incident he has been left struggling to talk and unable to do anything for himself.
The MP’s lawyers later served the media house with a demand letter terming the story as “scandalous and libelous” and aimed at pitting him against the public
