DPP Haji wins big as DCI led by Kinoti loses in a petition filed before Justice Odunga who ruled in favor of DPP

Justice Odunga while ruling on a constitutional case to determine between the DPP & DCI among the two who has powers to prosecute criminals or suspects in the country delivered this ruling :

A declaration that the 2nd respondent, the Director of Criminal Investigations has no power and authority to institute criminal proceedings before a Court of law, without prior consent from the DPP and any proceedings so commenced are unconstitutional, illegal, null and void ab initio” Part of the ruling blared from the Justice Odunga.

This is a landmark ruling that puts the DCI and DPP logger heads to rest.

Remember Mudavadi has cautioned the two agencies on the stand off.

A petitioner who moved to court to seek clarification from the bible all Kenyan laws, got his way as Justice Odunga interpreted the law as it is stipulated in the bible. This ruling, quells the long standing war between the DPP and DCI.

All cases that were taken to court by the DCI means now nothing unless the DPP recommends them once again. Kinoti will have no option but to hand all the investigative files to the DPP to consideration of prosecution.

This means all cases under prosecution that DCI had handed to the courts will have to collapse and investigation to begin a fresh and wait for DPP recommendation.
