President Uhuru Kenyatta today at State House, Nairobi received the \nReport of the Tribunal Investigating the Conduct of High Court Judge \nMartin Mati Muya.<\/p>\n\n\n\n
The Tribunal was initiated pursuant to a Petition by the Judicial Service Commission (JSC) addressed to His Excellency the President dated 8th May 2019, in line with the provisions of Article 168(5) of the Constitution of Kenya and founded on the provisions of Article 168, as read together with Articles 10, 73(1)(a), (b), 75(1) and (2) of the Constitution of Kenya, alleging gross misconduct or misbehaviour on the part of the Hon. Mr. Justice Martin Mati Muya. <\/p>\n\n\n\n
The unanimous finding of the Tribunal was that the allegations \nagainst the Judge have been proven. Accordingly, the Tribunal \nunanimously recommended the removal of the Hon. Mr. Justice Martin Mati \nMuya from the Office of Judge of the High Court of Kenya.<\/p>\n\n\n\n
The Tribunal was chaired by Justice (Rtd.) Alnashir Visram, had the membership of: Lucy Kambuni (Vice- Chairperson), Justice (Rtd.) Festus Azangalala, Ambrose Weda, Andrew Bahati Mwamuye, Sylvia Wanjiku Muchiri and Amina Abdalla. Others were Paul Nyamodi (Lead Assisting Counsel) and Stella Munyi (Assisting Counsel) as well as Peter Kariuki and Josiah Musili as Joint Secretaries.<\/p>\n\n\n\n
The complaint against him was filed by NIC \nBank, a defendant in a matter before the High Court in Bomet, one Alfred\n Kipkorir Mutai and Kipsigis Stores.<\/p>\n\n\n\n
\u201cIn\n that case (HCC NO 4 of 2016), the judge, after numerous adjournments, \ngranted an injunction and reserved the reasons thereof for a period of \nfive months,\u201d states a statement released by the JSC.<\/p>\n\n\n\n
